Terms of Service

These terms govern your use of the Canny Penny iPhone app and cannypenny.com (the "Service"), provided by Mikhail Mendel ("we", "us"). By using the Service you agree to these terms.
1. The Service
Canny Penny reads supermarket receipts you provide and presents spending insights, price trends and savings suggestions. The Service is provided for personal, non-commercial use. It is intended for use in the United Kingdom, and is designed and tested for UK supermarkets and for receipts in English; we do not guarantee it will work correctly for receipts from other countries or retailers, or in other languages.
2. Your account
You sign in with Apple. You are responsible for keeping access to your Apple account secure. You must be at least 16 years old to use the Service.
3. Acceptable use
You agree not to misuse the Service, including: attempting to disrupt, damage, or gain unauthorised access to it; reverse-engineering, decompiling, or copying it; scraping or collecting data from it by automated means; placing an unreasonable load on our systems; submitting content you have no right to submit; using it unlawfully; or attempting to access other users' data. You may only send receipts and content that relate to your own purchases.
4. AI and accuracy
Canny Penny uses artificial intelligence to read your receipts and to power Penny, our in-app assistant. Penny is an AI, not a human. Because AI works automatically, everything the Service produces is generated automatically and may be inaccurate, incomplete, or out of date — this includes the details we extract from your receipts (such as store, date, items, quantities, prices, promotions and totals) as well as Penny's answers, spending insights, price comparisons and savings suggestions. We do not guarantee that any of it is complete or error-free. It is provided for general information only and is not financial advice. Always check important figures yourself, and note that comparison prices may not reflect current in-store prices.
5. Your content
You retain ownership of the receipts and content you submit. You grant us a licence to process it solely to provide the Service, as described in our Privacy Policy.
6. Our intellectual property
We (and our licensors) own the Canny Penny app, the website, and all related content and intellectual property. We grant you a personal, limited, non-exclusive, non-transferable licence to use the Service for your own personal use in line with these terms. You may not copy, modify, distribute, or create derivative works from the Service except as allowed by law.
7. Changes to the Service and these terms
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free, and we may change, suspend, or discontinue features for valid reasons — such as improving the Service, keeping it secure, meeting a legal requirement, or for technical reasons. If we discontinue the Service, we will give you reasonable notice and let you export your data before it is deleted. The Service is currently free of charge; any paid features would be offered under separate terms. If you have paid for a subscription and we discontinue it, we will stop further charges; where you purchased through the App Store, refunds are handled by Apple under their terms, and where we billed you directly, we will refund any unused prepaid period.
We may also update these terms from time to time. We will only make changes for a valid reason — for example, a change in the law, a change to how the Service works, a new feature, or security. We will give you reasonable advance notice, in the app, of any significant change to these terms. If you do not accept a change, you can stop using the Service and delete your account at any time. If you keep using the Service after a change takes effect, you accept the updated terms.
8. Termination
You may stop using the Service and delete your account at any time from within the app; doing so deletes your personal data as described in our Privacy Policy. We may suspend or end your access if you break these terms, or where we reasonably need to for legal, security, or technical reasons. Where we can, we will tell you first and give the reason; otherwise we will tell you promptly afterwards.
9. Apple App Store
If you download the app from the Apple App Store, you acknowledge that: these terms are between you and us only, not Apple, and Apple is not responsible for the app or its content; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product-liability, legal or regulatory, or intellectual-property claims); and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, that you are not on any U.S. Government prohibited-parties list, and that you will comply with any third-party terms that apply when using the app.
10. Liability
To the extent permitted by law, the Service is provided "as is" and we are not liable for any indirect or consequential loss arising from your use of it. Nothing in these terms affects your legal rights as a consumer, or excludes liability where the law does not allow it.
11. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
12. General
These terms are the entire agreement between you and us regarding the Service and replace any earlier agreements. If any part is found unenforceable, the rest continues to apply. We may transfer our rights and obligations under these terms to another organisation — for example, if the Canny Penny business or app is sold, merged, or reorganised. We will give you at least 14 days' notice, and the transfer will not reduce your rights under these terms. If you do not agree to the transfer, you can close your account and stop using the Service at any time. You may not transfer your rights or obligations without our consent. If we do not enforce a right, that is not a waiver of it. We communicate with you in the app, and you agree to receive communications this way. We do not send you marketing emails. We only email you for service reasons — for example, one-time setup instructions if you ask Penny for them and give us an address (we use it once, then discard it), or a reply when you contact support. Any notice we must give you (for example, a change to these terms) will appear in the app.
